Speak Out 9/7/08

Sunday, September 7, 2008

Enough cowboy antics

Resident Russophile Jon Rust's recent rhetoric aside, I would rather not have a hot-headed, impulsive, trigger-happy McCain dealing with a resurgent Russia than a talk-first, shoot-later president, more prone to pursuing diplomacy first than exercising the military option in a knee-jerk style. We've had enough of cowboy diplomacy.

Professor's campaigning

The Speak Out caller who criticized a Southeast professor for openly campaigning outside the classroom (he has every right to do so) did so because the professor was (in the caller's opinion) campaigning for the wrong candidate.

Palin doesn't have time

The media needs to lay off a thorough vetting of Sarah Palin because she is a woman attempting to take care of a large family and possibly become the vice president. She doesn't have time for all that mess.

Muzzle please?

Cindy McCain says she disagrees with Sarah Palin's belief that abortion should be prohibited, even in cases of rape and incest. Will someone in the GOP please muzzle the beer baroness?

Not a maverick

The McCain-Palin 'maverick' and 'reformer' claim is really falling apart. One by one McCain is abandoning every sane position he held as a senator in order to mollify the right-wing extremists of the Republican Party. Meanwhile, Governor Palin rejected the "bridge to nowhere" but kept the money. If I did this, it would be called embezzlement — and I'd probably end up in jail.

A Palin pummel

Sarah Palin will pummel Joe Biden so badly in the upcoming vice presidential debates that he might as well concede.

Laws on breaks

In regard to the uninformed person who stated in the Sept. 4 Speak Out that there is a law that employers have to give you a lunch break and two 15-minute breaks every day, I say you must brush up on facts. Neither the federal law nor Missouri law requires an employer to do that. They also do not have to give vacation time, holiday pay or any other paid time off.

Violence in Chicago

I just read that the number of people shot and killed in Chicago this summer was twice the number killed in Iraq. Why would our country elect as president someone whose main claim to fame is being a community activist in one of the most screwed-up cities in the world? Democrat politicians have thrived in the corrupt cultures of our cities. Detroit, New Orleans and Chicago are testaments to their incompetence. Why should we give them the rest of the country to ruin?

Learning is No. 1 job

As a teacher, I do take recess away from students for not completing their homework on a continued basis. My students have ample time to do their work in class, and they have little homework during the week. If they cannot take the responsibility to do the small amount of homework that they have and complete their learning assignments which are top priority, then I will take their recess away. It is my job to make sure that they are learning.

Toward the center

I agree with nationally syndicated columnist and commentator Charles Krauthammer who noted the oddity of a Republican (John McCain) accepting his party's nomination and then attacking his party. Will it work? The independent voters will tell the tale. One thing is for sure. This nation has shifted from center, center-right to center, center-left. For the time being, Reagan conservatism is dead.

Battleground anecdotes

I know it's a cynical spin, but when I listened to John McCain's acceptance speech it seemed like his anecdotes about helping families were confined to only helping families residing in battleground states.

Freedom applies to all

It's good to see the right-wingers are out again — pushing back the boundaries of freedom — to agree with them. Why is it that the good right-wing, freedom-loving folks think that others give up their freedom to express themselves when employed by the state? In a nation that supposes itself to love freedom, anyone — yes, even a university professor — should be allowed freedom of expression. And when years of academic study and research lead professors to political conclusions, rather than trying to suppress their views, an intellectually curious person would want to hear them. But intellectual curiosity has never been the hallmark of right-wingers. And this freedom-loving right-wing Speak Out contributor thinks professors should be suppressed even when speaking their views in a bar far away from campus or classroom. Thanks for the defense of freedom and liberty.

I also noticed that Geraldine Ferraro was very supportive of Gov Palin's competence to do her job despite the slams against her for having a large family. Who would have 'thunk' it? giggle

Bob

You asked for comments after watching the documentary on Sarah Palin. I had watched it before but with distractions. I am watching it again and have learned some new information. Her father had four children in college and was having a difficult time finacially. She entered beauty contests to win scholarship money and won. She graduated with a degree in journalism and political science.

"From what information I can get from London's press, Saddam was no threat to the US. Were those planes fired on flying over the sovereign nation of Iraq?"

You are right on the money, Hilleco. When bush, condasleeza Rice and McCain talked about Russia invading a sovereign nation, and they did so with such condemnation, I wanted to scream and wail at the same time.

There was bush, talking so eloquently about the sovereignity of nations, all the while, he had sent our troops thousands of miles from our borders to attack two nations who had never done a thing to us.

I used to have a radio interview from the BBC where they discussed President Saddam Hussein and how he wasn't at all like the mad man that we were told. Nor, was he a butcher, either.

US Generals confessed on TV during the invasion that they weren't certain that President Hussein had gassed his people. The Generals speculated that it could have been some errant Iranian chemical artilery shells that had been meant for Iraqi troops near by during their war.

300 or so Kurds were arrested after an assassination attempt upon President Saddam Hussein's life. They got speedy trials, and speedy execution of their sentences. Not all were found guilty. What would happen if bush showed up in say, bush showed up in Jackson, and there was an assassination attempt agaisnt him. Say there were about 300 plotters. What do you all think would happen to them? We are at war, dontcha know. Wonder if they would get those speedy US military tribunals?

Regardless, what if bush showed up in Jackson, and a crowd of a thousand showed up with their rifles and shotguns and began firing them into the air in celebration of his arrival. What do you think that the SService would do at the sound of the first shot and the spotting of the "weapons" in the hands of the spectators?

President Saddam Hussein would show up in public, and people would shoot their lawfully owned FULLY AUTOMATIC rifles into the air in celebration of his arrival. No one got shot in return by President Hussein's bodyguard detail.

Just_Me_and_My_Opinion: In your answer to Suelynn I detect your approval of the UN having sovereignty over US policy. Since there are worst regimes in the world than Saddam's was, why doesn't the UN demand that we kick out their governments? From what information I can get from London's press, Saddam was no threat to the US. Were those planes fired on flying over the sovereign nation of Iraq?

And I didn't leave out any of the other verbage related to WMD or anything else to try and cover anything up. You can read the res tof the verbage. And the media has done a good job of taking hte other paragraphs into the ground, but has effectivley mind numbed the public into believing it was all about the WMD. Nothing else. I'm just so annoyed that people don't take the time to read the very resolution that sent us to a war. I don't know which is worse ... apathy or ignorance ... or maybe a combination of both. Good night.

Just_Me_and_My_Opinion: To answer your first question; I am a libertarian and thus a capitalist and very much against socialism. The answer to the second; I believe that taxation using the muzzle/threat of a gun to collect it, is done to satisfy the greed of some none producers. Since both political parties practice this same policy, then I would consider it unpatriotic for me to vote for either party.

I consider Democrats and Republicans to be moving in th direction of socialism.

Please read. Please take time to understand the world around you. If you're too apathetic then please don't waste your time voting. Here ya' go, from the "top", here's some excerpts from the bi-partisan resolution that sent us to war related to your blatantly erroneous post ...

Whereas the Iraq Liberation Act (Public Law 105-338) expressed the sense of Congress that it should be the policy of the United States to support efforts to remove from power the current Iraqi regime and promote the emergence of a democratic government to replace that regime;

Whereas Iraq persists in violating resolutions of the United Nations Security Council by continuing to engage in brutal repression of its civilian population thereby threatening international peace and security in the region, by refusing to release, repatriate, or account for non-Iraqi citizens wrongfully detained by Iraq, including an American serviceman, and by failing to return property wrongfully seized by Iraq from Kuwait;

Whereas the current Iraqi regime has demonstrated its continuing hostility toward, and willingness to attack, the United States, including by attempting in 1993 to assassinate former President Bush and by firing on many thousands of occasions on United States and Coalition Armed Forces engaged in enforcing the resolutions of the United Nations Security Council;

Whereas Congress in the Authorization for Use of Military Force Against Iraq Resolution (Public Law 102-1) has authorized the President "to use United States Armed Forces pursuant to United Nations Security Council Resolution 678 (1990) in order to achieve implementation of Security Council Resolutions 660, 661, 662, 664, 665, 666, 667, 669, 670, 674, and 677";

Whereas in December 1991, Congress expressed its sense that it "supports the use of all necessary means to achieve the goals of United Nations Security Council Resolution 687 as being consistent with the Authorization of Use of Military Force Against Iraq Resolution (Public Law 102-1)," that Iraq's repression of its civilian population violates United Nations Security Council Resolution 688 and "constitutes a continuing threat to the peace, security, and stability of the Persian Gulf region," and that Congress, "supports the use of all necessary means to achieve the goals of United Nations Security Council Resolution 688";

Robert -

What ... Nothing to say about Obama wanting to kill a commie for mommy? Come on! No matter how deep your affection for BO, surely you won't let that affection override your entrenched hatred for the US military and our servicemembers. Obama wanted to join the war machine, but didn't because "Vietnam was over". Oh, Bobby, how that must tear at the fabric of your soul.

I started thinking about that post when I went to bed. If a person is a participator in the plunder of this nation's wealth, how could they possible be considered a patriot? How could anyone consider it a patriotic duty to vote for either party? As a libertarian, I have to wonder about their patriotism.

Asssociated Press, Sep 7, 2008, WASHINGTON — Democrat Barack Obama says he would delay rescinding President Bush’s tax cuts on wealthy Americans if he becomes the next president and the economy is in a recession, suggesting such an increase would further hurt the economy.

Seems like BO may now have flipped his flop, and now thinks that "same failed policies of the Bush administration" are actually good for the economy? It'll be interesting to see if anyone picks this story up and runs it tomorrow...

Here's an oldie but a Goldy to end the night!!
God bless, hope to see everyone tomorrow.

A rabbit and a snake, both blind from birth, happen to meet in the forest one day. They get to talking and the rabbit asks the snake, "Would you mind running your hands (not knowing what a snake looks like) over my body and telling me what kind of an animal I am? I'm too embarrassed to ask my near-sighted friends because I'm afraid they'll make fun of me."

The snake says, "Okay," and proceeds to wind himself around the rabbit from one end to the other, then back again. "Well," the snake says, "You're kind of warm with real soft fur and you have two very long, fury ears."

The rabbit thinks about that for a moment and then exclaims, "W O W! I must be a bunny!" and he hops around and hops around and starts hopping away.

"Wait!" shouts the snake, "What about me? Come back here and do the same thing for me!"

The rabbit hops over and with his fury little paws, pats the snake from one end to the other and then back again. He sits down without saying a word.

"Well?" asks the snake, "What kind of animal an I?"

"I'm not really sure," says the rabbit. "You're kind of cold and slimy, and for the life of me, I can't tell your head from your rear end."

The snake thinks and thinks about this, then exclaims, "W O W! I must be a politician!"

Robert - I know that you have a terrible disdain for the military and refer to us as rapists, murderers, plunderers, etc. Thought you'd like to read this ...

"Mr Obama was asked by George Stephanopoulos of ABC's "This Week" programme whether he'd ever thought about military service and replied: "You know, I actually did. I had to sign up for Selective Service [a means of conscription in case of war] when I graduated from high school.

"And I actually always thought of the military as an ennabling and, you know, honourable option. But keep in mind that I graduated in 1979. The Vietnam War had come to an end. We weren't engaged in an active military conflict at that point. And so, it's not an option that I ever decided to pursue."

Sounds like BO wanted to get in on some action. Maybe wanted to kill a commie for mommy! Maybe he wanted to kill em' all and let allah sort em out!

Some great news from the NY Times via the Drudge Report ...

"After months of accusations of political bias and simmering animosity between MSNBC and its parent network NBC, the channel decided over the weekend that the NBC News correspondent and MSNBC host David Gregory would anchor news coverage of the coming debates and election night. Mr. Olbermann and Mr. Matthews will remain as analysts during the coverage.
The change — which comes in the home stretch of the long election cycle — is a direct result of tensions associated with the channel’s perceived shift to the political left."

Hilleco.....Political Parties

I feel about the same way that you do about our two major parties, at least when it comes to national candidates. I believe that after awhile, that they, Democrats and Republicans in Washington, join their own party.... the GOOD FRIENDS PARTY.

After much internal debate, I have put the my thought that I would not vote for either McCain, or, Obama aside. One of those two will win the election. I do not want to see a third term of the Bush program, nor, McCain attacking Iran, Russia, Pakistan and going through with the AFRICOM agenda.

So, I may hold my nose, I may not, but I will vote for Obama.

"Toward the center"

You are right, however, Reagan conservativism didn't die recently, it died two months into Reagan's term as President in 1980. It died when the son of Bush's Teaxas Primary campaign guy, a close Texas oil buddy of George HW Bush, shot Ronald Reagan. Reagan was supposed to die in that attack, however, when he lived, George HW Bush and friends made Ronald Reagan an offer that he could not refuse. They would take over the government, Ronald Reagan would be the figurehead, the face before the cameras, but the George HW Bush conspirators would actually run the government. In exchange, Ronald Reagan, and Nancy would live.

The globalists were in charge, they have been in charge since 1980.

I hadn't had a chance to check the Neilsen ratings until this evening ... what a shocker. The RNC pulled in more viewers than the DNC, and McCain and Obama each had 42.4 million viewers each (and Palin's numbers destroyed Biden's).

McCain-Palin are up in the polling -consortium polls show them up 3% (a 6-8 point swing). Tomorrow's polls will have the post convention data, so we'll see what kind of bounce they got. It'll be interesting to see how the lead holds up as BO-Biden have started pouring the cash into their ad campaign.

Dang, I go and get pre-occupied for a day or so, and all the good stuff breaks loose :-)

Hear all these opinions about how bad the last eight years have been - just wondering how much is due to true decisions of the administration, how much carries over from decisions of previous administrations (after all, the economy and other stuff doesn't typically turn on a dime - just how long is the average time between a cause and the full effect?), and how much is just circumstance - being in the wrong place at the wrong time, or the right place at the right time? For example, what if the Internet and related tech boom wouldn't have occured - how would Clinton's term be viewed? If Carter wouldn't have inherited already high inflation, and then the Iran crisis - how would his term be viewed? Not looking to argue - just wondering, 'what if'?

One thought on the comment about the past characteristics of political parties and taxes - perhaps if the other party would've been in control, the tax increases would've been much higher? :-)~

Looks like one candidate has some damage control to do because of his gaffe, or was it a subconscious slip?, toward religious orientation. Then, the other candidate has some shplainin' to do about his wife's reported $300,000 attire. Some days, it just doesn't pay to get out of bed.

And a highly respected source - AOL news:-)~ - is reporting that Palin is willing to be interviewed:

That "guy in Venezuela" his name is Hugo Chavez. Sorry but he isn't exactly a dictator. He may have some crazy speeches and say wild things to get the attention of the media. I am sure you do not like him because you feel that socialism is bad and so forth. But the truth is SouthAmerica(if you didnt know that is where venezuela is) is leaning to the left. It is because it is the style of Gov. that works best for the people. Chavez has actually helped people through the gov. He has been able to take money from state owned oil and redirect it to people who need the money. Not only has he done this but he has successfully started to integrate south america. Americans are scared of that since well it is "our backyard" our forgotten backyard.

Another thing Democrats: Republicans love to tax. Here in Bollinger County, a county in which it is nearly impossible to get elected as a Democrat, the county voted in a half cent sales tax. Another Republican majority city East of here voted in a half cent sales tax.
The Federal Reserve Chairman called today's inflation rate a tax. He was appointed by a Republican President and the Secretary of the Treasury, the money printer, was also appointed by a Republican President.
So get this straight Democrats, you have lost the title of the tax and spend party to the Republicans.

Voting for change hasn't worked very good in the past; ie FDR-who would have become a dictator like the guy in Venezuala had God not intervened with an untimely death; and Jimmy Carter-change because Nixon was a Republican.

I hope that we can move on and get over the damage that 8 years of a worthless president and VP, as well a pointless war. YAY go repubs!! You have a track record of successful tactics.

Babe - Me' Lange will be back. She's told me twice that she was done with me. Don't worry ... her memory and her word aren't long on much.

Theorist - Again, the governor appoints the Adjutant General. The governor can, as was the case several times with Mrs. Palin, delegate decision making authority to her cabinet. In the case of deploying a C17 to LA to assist in Hurricane relief ... that was Mrs.Palin's decision.

Have you come up with any Obama legislative magic (again, you know, things he's sponsored that have actually become law)?

Which brings up another curious point...

Why will S Palin not be interviewed by the media?

The republican party says she will when she is ready....Hmmmmm are they afraid?

Why do Republicans and Democrats bring up entitlements? The Democrats have not raised entitlements or welfare nearly to the extent of Republicans in the last 40 years. A Republican Congress passed and a Republican president signed into law a bill for prescription drug coverage that may end up costing more that SS years down the road. So Democrats, you don't have a leg to stand on by claiming that Republicans don't care about health and welfare.

iago1,
How the federal dollars are spent in Alaska is exactly the point. Governor Palin has no say whatsoever in what the Federal Government spends on it's land, pipelines, missiles, military bases, or borders for that matter; none. She may well be against all the Federal funding, but it doesn't matter 'cause she ain't got no say in the matter!'

The fact that you refuse to comprehend her lack of control in the matter of the Federal Government spending $$ in her state uhmmm.....

....speaks volumes.

-- Posted by John in Jackson on Sun, Sep 7, 2008, 7:00 pm CDT

MeLange

It doesn't matter the population of Alaska. One could fit 250 Delawares into the state. The sheer responsibility of governing a state that has logistic shipping concerns, vast amounts of government owned lands, close proximity to Russia, important oil and pipelines multiple ethnic groups, fishing rights etc makes Biden's senatorial experience miniscule.

-- Posted by BABE on Sun, Sep 7, 2008, 6:58 pm CDT

Obama had a whole lot of obstacles to pass before he chose Biden. Now that choice has probably cost him the White House. His inexperience could have been a non issue if he would have swallowed his bitter pride and chose Hillary. Even though she has little experience herself she does have BILL. And 18 million ticked off followers!! Believe me I considered him before the Primaries because like so many others I'm sick of life long politicians doing the same crap year after year. I decided against him because the Rev. Jeremiah Wright convinced me that Obama is a racist.(man I hate to bring that up again)

Do I need to go back and explain that the Adjutant General is a political appointment - appointed by the goivernor? (I go away for a couple days and your digress back into this ... for shame.)

And the by the way, there are several of us who are still waiting on details of Obama's legislative accomplishments (you know, things he's sponsored that have actually become law). Please detail what he's done to make life better for his constituents. Thanks.

Babe,
Kindness comes in various shapes and sizes. Sometimes kindness is as simple as over-looking the fact that someone might be a cranky because they are dealing with health issues or had a bad day.

Sometimes kindness can be a simple gesture like saying good morning and wishing others well.

Sometimes kindness can be accepting others engrained, gruffy personalities...as one knows they can not change another.

Sometimes kindness is just being polite, having good manners and courteous.

Sometimes kindness is finding a way to productively give back, in whatever way they can.

Sometimes kindness is recognizing OUR actions, shared thoughts and behaviors DO affect others.

I could go on all night. I never betray a confidence (if that is what you were prodding me to do). AND I never expect anything in return OR want and/or expect recognition or reciprocation when I offer kindness.

However, I have learned...appreciation DOES encourage others to continue to offer kindness.

Granted she may have executive experience but what worries me is her lack of international relations. Granted our current president sure had a lot of "executive experience" and look at our country now. I chose to follow Obama because I think he can change this country. I believe that himself and Biden will be a very good team. Granted not everyone needs to feel that way. My father sure didn't tell me to feel that way nor my professor. All that I know is that surely Obama did something right to get this far and claim the nomination. To me that shows more credibility then McCains VP pic who no one had ever heard of.... Because.. well she really has not done anything to credit herself.

"She is a Gov. of a very large state" True, but Alaska's population is approximately 675,000. If I counted correctly, one of only seven states under a million. Delaware, 864,000; Montana, 857,000; N. Dakota 639,000; S. Dakota 796,000; Vermont 621,000; Wyoming 523,000; District of Columbia 589,000; (Didn't count Guam 173,000; or Virgin Islands 109,000.)

Link to Alaska's population density per mile...

btw...U.S. has more cities over a million than states less than a million. (And Mayors who may be AS qualified...) Charlotte North Carolina; Memphis Tennessee; Fort Worth Texas; Austin Texas; Columbus Ohio; San Francisco California; Indianapolis, Indiana; Jacksonville Florida; Detroit Michigan; San Jose California; Dallas Texas; San Diego California; San Antonio Texas; Philadelphia Pennsylvania; Phoenix Arizona; Houston Texas; Chicago Illinois; Los Angeles California; and New York City New York--to name a few.

Its obvious to me that you are a person that is incapable of doing your own research. IMO a manager of a Wal-Mart super center (with probably 300 employees) has more administrative experience than BOs 173 days in the senate. He follows he has yet to lead any one on any topic. For crying out loud do you think Kerry, Kennedy, Biden or any of the other life long senior senators in Washington are going to step aside to a skinny community organizer just because Oprah likes him?? He was told when he got to Washington to not make waves. The same thing they tell all of the incoming freshman senators. What happen next is already in the history books. Her qualifacations may not be what YOU would like to see but she still has more executive experience than Obama and Biden combined. And yet people like you refuse to give any respect where respect is due. You cant prove Me wrong all you want to do is march along in the parade in support of Obama because your professor or daddy or union rep. told you to.

Have you ever traveled outside of the USA? Have you seen society where the Gov. has done nothing for its people? I have. I know that some gov. in the life of people is good. Sure repubs dislike raising taxes and supporting other people with your own money. Get over it. Every person is entitled to some help. You happen to think that every person is born onto the same playing field. LIE. MISCONCEPTION. Maybe everyone from your social pool but I can assure you that the rest of the world might not have the choices, have the opportunities that we have been granted. Take away taxes, take awake the small things our gov. does for people then this country will really be a 3rd world country. Would you like to know the great thing about 3rd world country's. The rich live side by side the poor, while the rich get richer, and well the poor just stay poor.

Apologies Right-wing nuts!!

Mrs. Palin seems to be a very succesful woman with a nice family maybe alittle misguided on the whole conservative ideal of abstinence, but not important(they are getting married) I wonder how her daughter and Boyfriend really feel about that. She has worked hard to get to where she is. She is a Gov. of a very large state and that is quite a good accomplishment. Just one thing that gets me she must just be that amazing seeing as John "McBush" McCain only needed a few hours to determine that if it need be done she could lead all 50 states(if something were to happen to John). That to me is quite an accomplishment or was it maybe that John McCain thought "hey I want to get more female votes!" and appeal to all those Pro-lifers out there(which I do respect people who respect life) But the fact that McCain is using her for no other reason then glamor and fame, is just disturbing. I guess If you have been brain washed by right-wing ideals all your life you could look right over this little insight.

God Bless America :)

Theorist

With hind sight being 20/20 I think I can state that my uncle is correct, Because...I own several guns as I have told you before BUT I insist on a legal purchase for all of my weapons because I don't want to end up with a hot (stolen) gun in my arsenal. A few years ago I made more than six purchases in a years time and when I tried to make the 7th I was put on the three day hold by the ATF, I was able to make the purchase after a day or so and when I asked the clerk at Wal-Mart about the hold he informed me that multiple purchases in a short time would constitute a hold.

Fast forward a couple years (last Christmas) I gifted my two sons new shot guns for turkey hunting, and again I was put on the three day hold. But when they called me to pick it up I was able to add a third gun for myself without another check taking place. I can't figure out the laws so there fore I don't usually go to the gun shows, (too risky) in my opinion!!

-- Posted by Silent_Bob on Sun, Sep 7, 2008, 5:42 pm CDT

Silent Bob,

There is a provision under RSMO 610 to expunge records of arrest under certain circumstances and they will not show up on any criminal background check. Unlike many states, however Missouri has very limited circumstances under which a record of arrest or conviction can be expunged.

Also a NICS check will not be done on private sales of firearms. This is something many Democrats are trying to change. I am not in favor of it, but that is just me.

-- Posted by Red_Rhino on Sun, Sep 7, 2008, 5:39 pm CDT

Theorist,

The problem, if there is indeed one is with the juvenile justice system and not with "gun laws". "Any" adult convicted of "any felony" cannot legally own a firearm due to the conviction. Juvenile adjudications are not considered "convictions" by most jurisdictions. If the law was changed to do so then there would be no problem. I am not advocating all juvenile adjudications be considered convictions, but certainly ones such as this should be.

Legislation was passed in Arkansas and signed by Governor Mike Huckabee which allowed life sentences for instances such as these.

Again, I only reported what I found on the Internet which was all in newspaper articles and can certainly not give a definitive answer on whether or not they could legally possess firearms. While it "appears" they could, I am willing to defer to someone with more knowledge on this subject.

In the interest of full disclosure, my position on firearms laws are close to those of the Libertarian Party as after over thirty years in the criminal justice system, I have not seen where firearms laws of any type have had any affect one way or the other.

"Good people do not need laws to tell them to act responsibly, while bad people will find a way around the laws." - Plato (427-347 B.C.)

Theorist:

For the sake of the debate I just spoke with him (sorry he asked that I not give out his info because he is retired and don't want to be part of what he called a Silly debate like this) and indeed you are correct BUT so am I, kinda crazy huh.
Johnson is eligible to purchase a weapon in any state that he can pass a back ground check HOWEVER the ATF can red flag his purchase indefinitely if they choose to and if they are paying attention to the social security number. My understanding is that no matter what state they reside in they are both on a watch list. If a call was to be made to a police dept. in any city the officer would be informed of their past history (if the caller could say give enough info ie.SSN) so he could be prepared for violence!!

Now I was just informed that Missouri is a great example of how your background is tracked. Lets say you were once charged with assault on a police officer and then for some reason charges were dropped. If the law was called on you again they would know that there was at least a possible chance that you may fight with or resist them.. I was unaware of this I thought that in order for something to be on your record you had to be convicted, But good old unck told me that there are several facets to a criminal record. Such as an arrest record vs a conviction record. Go figure!

And just for the record he was only an advisor on the case for a short time, He did not take part in the trial.

YES I am a crazy flaming liberal. It is reading these comments of pure stupidity that make me feel and live so much more liberal everyday. Thank you RightWing Nutts! You feed my fire :)

Thanks Red Rhino

I knew this and read the same information. I also knew he was eligible to own a firearm, even though he was convicted of killing 5 as a 13 year old.

Silent Bob is the one who said he was not eligible to own a gun. In all fairness, I believe Arkansas is working to remedy the injustice here with new legislation. I do not know how far along or the particulars of the new law.

This is, to me, an example of how unregulated US laws are in regards to gun ownership. Always a sensitive topic in this area, but times have changed!

Catching up on leisure reading...chuckled when I read this blurb in Woman's World.

"Just 10 minutes of chatting with someone--even online--will short-circuit a bad mood, research shows."

Most days, a few weeks back, would have completely agreed with the online portion of the comment.

The main reason for the chuckle, Woman's World although stating "research shows"...did NOT offer the reader a citation of the research. (Recalling a debate Prudentdriver and I had a month or two ago.)

Theorist,

Did a little bit of research and Mitchell Johnson was convicted of being in possession of a firearm (handgun) while using or being addicted to drugs (marijuana) in Federal Court on January 28, 2008 and sentenced to four years in Federal Prison. He could have been sentenced to up to ten years. The information contained indicated he was not prohibited from possessing firearms due to his prior "conviction". I am not saying anyone is right or wrong, just reporting what I found.

Out for a while, yard to mow.

MeLange

Yes, I was speaking of the fair. The board should promote it, in my opinion.

Red_Rhino,
Thanks for sharing more...personally, found the information facinating. Not much bores me, well but...boredom itself. LOL

Babe,
I could be reading your comment wrong, but several local bars have poker tournaments (do NOT know the details...like if they have buy-ins, or what nots). Were you "just" speaking of the "fair" itself? My guess, the fair committee/board made that decision???

Hey...I'd be game if a group wanted to go play poker sometime. Which would win the hand--full house or four-of-a-kind? ~wink~ and/or ~giggle~

-- Posted by Me'Lange on Sun, Sep 7, 2008, 1:44 pm CDT

I was just reading about the washer tournament at the fair. I have a question. How can monetary prizes be given from a buy-in for this tournament and not allow a poker or texas hold 'em tournament?

Me'Lange,

I told you they were very complicated. Maybe I could have worded it more artfully. Federal Law does preempt state law unless the federal law gives them the option of interpretation which the FOPA did thus throwing many form prohibitions out the window. The FOPA said in essence that they will accept the states interpretation and be bound by it, but only if it meets their "approval". I don't want to bore anyone, but a couple of cases are relevant. A state passed a law in which it stated someone with a domestic violence conviction could have their record "expunged" and have their rights to own a firearm restored. This has always been counter to Federal Statutes, but under the FOPA an expungement meant just that, the record of conviction and all attendant disabilities would be nullified. The state was eventually overruled in Federal Court only because they wished to be able to bring up the "expunged" prior record as an enhancement upon another such conviction. The Federal Court said that this then did not constitute a true "expungement". If the state had left this out then it would have passed muster. Another state wished to be able to restore an individuals right to own rifles and shotguns, but not handguns. This was struck down as the Feds said the restriction on handgun ownership could not be viewed as having restored an individuals rights. It had to be "all or nothing". In another case, a Kansas Court convicted a Missouri resident for firearms ownership even though the person had a "suspended imposition of sentence" which is not viewed in Missouri as a "conviction", this was written about by former Missouri Supreme Court Justice Steven Limbaugh. The Kansas Court refused to recognize Missouri's interpretation even tough the Feds did. Like I said it is all very complicated even when you don't throw in the various juvenile applications.

Silent Bob,
I've given the situation more thought...I am sorry about a thing or two or four...

I'm sorry I didn't follow my own wisdom, as I DO know better than to trust my memory (too dang much medication over the last 20 years).

I'm sorry I didn't follow my own advice to "go look at the actually federal financial reports".

I'm sorry I allowed "Silent Bob" to bring out the worst in MY public forum behaviors.

I'm sorry I made a fool of MYself! hehehe (But it isn't the first time for that one either and I'm sure it won't be the last!)

I'm NOT sorry I questioned the topic, as we ALL (or many) learned something new! :-)~

Theorist,

I really try to avoid discussion of religion, but wars probably should never be viewed as doing the work of the Lord. Nations may engage in them in His name, but I just don't see it. I am not saying there is never a time to go to war, but doing so under that guise worries me.

Hilleco, Thank you for your kind words. I respect your post also, even if we don't agree once in a while. hehehe

Red_Rhino,
Not correcting, more or less questioning...wouldn't Federal statutes automatically preempt State statutes (no matter the subject matter)? Seems I've recently read "the U.S. Constitution is the supreme law of the land". Yet, Federal Supreme Court has the duties of interpreting the Constitution, thus they truly have the final determination on how out laws/statutes/Constitution are applied.

A cornerstone of the American and English judicial systems is based on Stare Decisis--a common law doctrine in which judges are obligated to follow the precedents established in prior decisions. (I'm supporting your thoughts about considering former rulings. ..."research Appeals Court Rulings and Supreme Court Rulings to find what is truly meant.")

Me'Lange: I respect your posts, but don't allow propagandists get to you. Their propaganda is built on half truths.

I don't think a teacher should ever deny a student recess for any reason. They need the break and exercise. Surely they can find another form of discipline for not turning in homework.

Theorist,

I realize that your post was not directed at me, but Federal Firearms Laws are extremely complicated on their own encompassing the National Firearms Act, 1968 Gun Control Act and the the Firearms Owners Protection Act of 1987 I think. One must then look at how they interact with State Laws as the FOPA states in essence that it will recognize certain state interpretations as over riding Federal Statutes if they meet certain criteria. I have spoken to many in BATFE over the years and even they often must consult with a Federal Prosecutor. As with most statutes one must go beyond the language of the statutes themselves and research Appeals Court Rulings and Supreme Court Rulings to find what is truly meant.

I would be inclined to accept the word of a BATFE Agent who works in a particular jurisdiction, but might question one who does not due to the FOPA provisions, but even then even a BATFE Agent can be mistaken unless they have researched that particular issue. But don't believe anything I say as I am not an attorney and have not researched this case though I am now interested for some reason.

Black Shadow,

I am however not really sure there will ever be long term peace in the middle east due to the culture. Just an irrelevant observation.
-- Posted by Black_Shadow on Sun, Sep 7, 2008, 12:30 pm CDT

I think this is a very important point! And at some point, we need to evaluate whether we are doing the work of the Lord, or whether we are trying to do his job for him.

Silent bob

You talk to your Uncle???

Remember? The one who knows all about the Jonesboro shootings?

-- Posted by Theorist on Sun, Sep 7, 2008, 12:30 pm CDT

War:

Not that it is all that relevant in the long run, but the US has had essentially fought two wars in Iraq. The first was against Saddam Hussein and the Iraqi Military which we clearly won and the second was against the "insurgency" or whatever you choose to call it which we may well be on the way to "winning" or at the very least stamping it down enough to turn it over to the Iraqi government. I am however not really sure there will ever be long term peace in the middle east due to the culture. Just an irrelevant observation.
