The Missouri Department of Natural Resources Clean Water Commission has granted Strack Excavating an operating permit at the site of its proposed quarry development off U.S. 61 near Fruitland.

The permit establishes effluent limitations and monitoring requirements for the site, which Hubble Creek flows through.

DNR's Air Pollution Control Program previously issued an air construction permit to Strack Excavating in December.

In January, Saxony Lutheran High School was granted an administrative hearing by the DNR Land Reclamation Commission on Strack's application for a mining permit from DNR. The Strack mining plan included a 55-foot buffer distance between the mining area and the school property line.

The hearing is expected to take place later this summer.

In addition, a case brought by Saxony and a group of Fruitland residents incorporated as Save Our Children's Health is still pending in Cole County Circuit Court.

The lawsuit questions the Land Reclamation Commission's actions regarding the proposed Strack quarry and a second mining application by Heartland Materials, LLC. The next hearing in that case is scheduled for June 10 in Jefferson City.
