CHARLESTON, Mo. -- A mistrial has been declared for a man charged with the kidnapping and murder of his estranged girlfriend. The reason: An insufficient number of jurors.

Mississippi County Prosecuting Attorney Darren Cann said the mistrial was declared in the case against Maurice Davis, who is charged with first-degree murder, armed criminal action, unlawful use of a weapon and kidnapping in connection to the Dec. 12, 2010, shooting death of Latosha Greer, 23.

The case was being heard in Cape Girardeau County on a change of venue.

Greer was found with a gunshot wound to the head in the backyard of a residence in Charleston. She was pronounced dead at the scene.

According to the probable cause statement issued after the crime, Davis took Greer, without her consent, from her residence to another house where he shot her.

Davis told police the shooting was accidental.

A new trial will be set when both sides return to court Jan. 14.
