Two arrested after man found beaten

Allen Wayne Biggs, 24, of Scott City and Ryan Perry Harkey, 27, of Cape Girardeau are accused of fracturing a man's skull, rupturing his eardrum and causing bleeding on the victim's brain during a beating.

Biggs and Harkey were charged with felony first-degree assault and resisting a lawful stop.

Police received a report of a man laying on the side of street about midnight Friday near 15 N. Main St. in Cape Girardeau, according to a probable-cause statement by Cape Girardeau police officer Aaron Bennett.

The victim and several witnesses reported two men running towards Broadway and North Main Street, Bennett wrote.

The first victim refused to file a report, but officers saw a second victim lying in the street near Broadway and North Water Street, according to the report.

This victim had the severe injuries to his face and head and was unconscious.

A witness said she was with the second victim and identified Biggs as approaching the victim before the assault.

Police saw Biggs and Harkey running from North Water Street and Broadway, Bennett wrote.

Harkey was found with what appeared to be blood on his right forearm and pants, the report said.

"Upon observing Harkey, he didn't appear to have injuries to his person which would justify blood being on his person," Bennett wrote.

Harkey told officers they had caught the wrong guys and it was three black men who were the perpetrators, according to statement.

Harkey also said he did not know Biggs but later called Biggs by his name, Bennett wrote.

Harkey's bond was set at $100,000 cash only, with the condition he have no contact with either victim.

Biggs bond was set at $30,000, with the condition he have no contact with either victim.
