Jackson School District agrees to $22K settlement in roller skating mishap

Attorneys for the Jackson School District and the mother of a 12-year-old student agreed on a $22,000 settlement agreement Friday in Cape Girardeau County Court.

Christine Windes, representing her daughter Alexis as a next friend, sued the district for damages related to injuries Alexis sustained during a rollerskating mishap Jan. 24, 2014, at a Jackson school.

Christine Windes declined to comment on the extent of her daughter’s injuries. Details of the incident were not included in court documents.

The majority of the settlement, $11,183, will fund periodic payments from Pacific Life and Annuity Services Inc.

Alexis will have access to these payments when she turns 18, according to Windes’ attorney, Ashley Vaughan. The second-largest portion of the settlement will go to Vaughan’s firm, Brown & Crouppen of St. Louis — $8,800 in attorneys fees and $935 for costs expended during court proceedings.

About $182 will be paid for medical bills, $150 to Perry County Physicians Services and $32.58 to Cape Radiology Group.

Christine Windes will receive $1,000 for expenses incurred by the family after the incident, including transportation costs.

Jackson schools associate superintendent Wade Bartels said liability insurance coverage will cover the settlement.
