A Scott County sheriff’s deputy was at the residence of a Morley, Missouri, man on a report of an aggressive pit bull. When standing outside the owner’s house, the deputy said he smelled marijuana coming from the man’s residence, eventually resulting in drug charges.

Scott County sheriff’s deputies arrested Nevin Lee Tanner, 21, on Sunday. The Scott County prosecuting attorney charged him with possession of a controlled substance with intent to distribute, misdemeanor possession of marijuana and unlawful use of drug paraphernalia.

Tanner’s bond was set at $25,000 cash or surety.

Tanner gave the deputy consent to search his residence about 8 p.m. Sunday, according to a probable-cause affidavit filed by deputy Brooks Brockmire. Tanner first said the odor could be coming from his car and was adamant his fiancée inside had nothing to with anything that could get her in trouble, Brockmire wrote.

Brockmire found about 30 grams of marijuana from six labels, including “Lemon Crack” and “Dat Gas,” and a small plastic bag containing psilocybin mushrooms, according to the affidavit.
