The victim, Brian D. O'Kelley, 26, of 3020 Boutin Drive, Lot 123, was treated at Southeast Missouri Hospital for a gunshot wound to the upper right leg. Cape Girardeau police then were summoned by the hospital at 2 a.m. Saturday and arrested Davis at his home without incident half an hour later.

According to Cape Girardeau police, the incident began when a friend of O'Kelley's assaulted him and stole his truck. Another friend was driving O'Kelley to the hospital when they saw O'Kelley's truck in the driveway at Davis' address. When they stopped, police said, an argument ensued between O'Kelley and Davis, who knew each other.

During the argument, police said, Davis purportedly fired three shots, one of which struck O'Kelley.
