Cigarette vending machines will remain in Cape Girardeau despite the concern raised by at least one city councilman Monday night.

Councilman Melvin Gateley had requested information regarding the possibility of prohibiting tobacco vending machines in the city.

Current ordinances only allow cigarette vending machines in areas of factories, businesses, offices or other places that are not open to the public or in public places where access is denied to 18 year olds.

Gateley had suggested the city consider deleting the portion of the ordinance that would allow sales in public places where access is denied by 18 years olds.

At Monday's study session, City Attorney Eric Cunningham said it is already illegal for those under 18 to purchase tobacco products in the city. If a minor attempts to buy cigarettes from a vending machine, the person can be charged, he said.

Councilman Richard Eggimann doubted if further rules and regulation by the city would stop minors from obtaining cigarettes.

"They're getting cigarettes somewhere and there's already a law on the books that they can't buy it," he said.

Mayor Al Spradling III said perhaps it is a matter of enforcing the ordinance already on the books. He added, "It sounds like we got it covered with no further regulation."
